Kyle Bierlein is a Senior Attorney in Miller Canfield's Employment and Labor Group. He advises clients in areas that include hiring practices, discrimination and harassment complaints, employee handbooks, termination practices, employee disciplinary actions and other employment compliance matters.
Kyle proactively works with clients to identify risks of litigation exposure, and his employment litigation experience includes business disputes, regulatory claims, administrative hearings and constitutional violation claims. He has represented clients in employment litigation actions, EEOC complaints and employee benefit disputes from case initiation though appeals, including handling all aspects of discovery, motion practice, and conducting trial as well as preparing appellate briefs and oral arguments before the Court of Appeals and Michigan Supreme Court.
Before joining Miller Canfield, he was an Assistant Attorney General for the Michigan Department of Attorney General's Labor Division and also a Judicial Attorney in the Wayne County Circuit Court. During his time at the Attorney General’s Office, he represented government agencies and executive officials through complex and often high-profile litigation actions and administrative proceedings. He also has extensive experience advising and representing clients in relation to OSHA inspections, investigations, citation appeals and settlement negotiations. He has successfully minimized the effect of enforcement actions after the issuance of citations for clients.
