Scott R. Lesser assists clients in commercial real estate workout and foreclosure matters.  Most assets are located in Michigan, but he has experience in Ohio as well.  Scott represents financial institutions and special servicers of CMBS loans alike in all manner of judicial and non-judicial foreclosures, receiver appointments and sales, construction lien actions, and forbearance, deed-in-lieu, deed-in-escrow, note sale, loan modification, and other settlement transactions.  Loans handled are secured by multifamily, industrial, condominium, office, or retail properties, and typically have principal balances ranging from as little as $250,000 to over $15 million.

Experience

Scott has experience resolving commercial real estate matters by many means, including receiver appointments, receiver sales, deed-in-lieu transactions, deed-in-escrow transactions, forbearance agreements, loan modification agreements, discounted payoff agreements, and non-judicial and judicial foreclosures. He also has experience pursuing guarantors based on recourse guaranties and carve-out violations of non-recourse guaranties, and dealing with condominium successor developer issues, emergency receiver appointments, and other matters.
