Andrew Warnecke is an experienced intellectual property attorney whose practice focuses on patent, copyright, trademark and trade secret matters. He has first-chaired patent, copyright, trademark, and trade secret litigation matters in a variety of venues, including district courts throughout the United States and Section 337 actions before the U.S. International Trade Commission (ITC). His litigation experience has covered a wide variety of technologies, including medical devices, computer software, consumer electronics, automotive manufacturing systems, and microchip technology.

Andrew is registered to practice before the United States Patent and Trademark Office (USPTO) and has significant experience drafting and prosecuting patent applications and rendering opinions addressing patent validity and infringement. He also has extensive experience in drafting and negotiating SaaS agreements and intellectual property license agreements. In addition, he has significant experience representing entities and artists in copyright infringement matters, particularly in the music realm and in connection with children's books.

Andrew received a degree in engineering from Purdue University and obtained his law degree at The George Washington University Law School. 

Representative Matters

  • Currently represents a leader in hybrid motor manufacturing technology, chairing a four-patent litigation covering technology relating to equipment used in stator manufacturing.
  • Represented drug manufacturers in federal district courts in Hatch-Waxman litigation. Andrew's ANDA experience includes preparing pre-suit noninfringement and invalidity analysis of Orange Book listed patents and counseling clients on strategic approaches to appeals to the Federal Circuit Court of Appeals.
  • Represented several medical device companies with respect to patents relating to spinal fusion implant cages and catheter designs, and routinely handles litigation centering around software technologies.
  • Represented a large Taiwanese corporation in an ITC action defending against allegations of infringement of three patents allegedly covering the company's PCs, motherboards, notebooks, and graphics cards, and seeking to exclude billions in U.S. sales. Managed all aspects of the case through trial and post-trial, and conducted direct examination of experts and cross examination of key witnesses. The client prevailed on all three patents with findings of no infringement and the full Commission adopted the ALJ's Initial Determination without review.
