Changes at the NLRB

William Emanuel was recently approved as a member of the National Labor Relations Board. Emanuel has extensive experience representing employers in various traditional labor issues, such as NLRB matters, collective bargaining, labor arbitration, union election campaigns, strikes, etc.

His approval by the Senate will result in the Board having three Republican and two Democrat members. Emanuel's nomination tot he Board was strongly supported by the U.S. Chamber of Commerce. It is expected that he will advocate for a more pro-business consideration by the Board. (The HR Daily Advisor offers its analysis here.)

While the term of one of the incumbent Republican members of the Board (Philip Miscimarra) will expire in December, it is expected that he will be replaced by another Republican. In addition, a management-side attorney, Peter Robb, has been nominated to be the new NLRB General Counsel and, assuming he is approved, will replace the current General Counsel Richard F. Griffin, Jr., whose term ends in November.

It is anticipated that these changes will result in the Board being more sympathetic to the concerns of the business community.
