Real Estate Development Group
The Real Estate Development Group of Miller Canfield provides clients with expert advise on real estate development issues and Polish real property law. The Group includes twelve Polish lawyers, in all three Miller Canfield Polish offices, as well as real property legal experts from its international offices as needed.
Scope of Services. Real Estate Development Group can provide expert legal advice and services in all aspects of real estate law, including the areas of real estate acquisition, development, leasing and construction. In addition, the firm also has extensive experience and expertise in real estate finance. We participate in transactions involving all types of real estate, such as the following:

Title and Land Use Issues
In connection with our representation of clients acquiring and developing real property in Poland, we have developed an expertise in examining land records and clarifying and settling issues involved with title to real property in Poland. Our experience includes rendering title opinions, securing ownership and possessory rights of real property through negotiation and court procedures, and generally resolving problems, including possible claims for reprivatization, associated with Polish real property. In addition, we have represented clients in obtaining favorable land use designations at the local municipal authority (gmina) for various commercial and industrial uses.
Governmental Permitting
Miller Canfield has much experience in obtaining for our clients the governmental approvals and permits needed to develop real property (e.g., Ministry of Interior), as well as the various construction permits needed for commercial, industrial and residential facilities and buildings. The firm's Polish Real Estate Practice Group includes nationally-recognized experts (and authors) in Polish construction law and permitting.
Ancillary Issues
In the course of a real estate development project, the firm is prepared to cover all ancillary issues and agreements which may arise, including, for example, the drafting and negotiation of space leases, ground leases, development agreements, operating agreements, cross easement agreements, maintenance arrangements, etc.
