Miller Canfield attorneys provide experienced counsel for clients dealing with contaminated properties and Michigan's unique liability scheme regarding their redevelopment.  Unlike most states, to comply with Part 201 of the Michigan Environmental, Natural Resources and Environmental Protection Act,  a purchasor of property in Michigan can do so without becoming liable for pre-existing contamination by conducting a Baseline Environmental Assessment (BEA) prior to owning or possessing the property.  There are also many incentives offered by the State of Michigan to redevelop contaminated property with which our attorneys are knowledgeable, providing clear counsel and advice to our clients in these matters.
