Intellectual Property Litigation
Miller Canfield’s IP trial lawyers have successfully tried all manner of business cases to juries, judges and arbitrators (domestic and international). Our trial practice clients include Fortune 500 companies, smaller businesses, individuals and governmental and non-profit organizations. We have achieved many significant victories for our clients. Some examples:
- The owner of a famous trademark engaged us to file suit against an adult entertainment nightclub operating using a similar name. After the evidentiary hearing, we obtained an injunction which required the establishment to change its name.
- We were retained by a global manufacturer to assist with its investigation of suspected counterfeiting in Southeast Michigan. We assisted the company in presenting the results of that investigation to the U.S. Attorney for the Eastern District of Michigan. Ultimately, the U.S. Attorney and agents from the federal government served warrants, arrested, and charged a key figure in the counterfeit underworld. That individual has agreed to a plead guilty and, as part of his plea deal, has assisted the company by, among other things, identifying the counterfeiters. He, individually, and on behalf of his now out-of-business distribution company, also agreed to a civil consent judgement and injunctive order and has executed an affidavit naming names, which will be filed in a separate civil action in federal court.
