With particular experience in automotive, product distribution, health care and sales representative matters, Miller Canfield’s Antitrust and Trade Regulation team represents parties in litigation and investigations involving antitrust, franchising, dealer laws and sales representative law issues. Our work has included representation of automotive suppliers and a pharmaceutical manufacturer in multidistrict antitrust class actions, representing a variety of clients in federal and state antitrust investigations, and representing many manufacturers and other principals against claims by terminated sales representatives, distributors, dealers and sales representatives.

We also counsel clients on compliance with state and federal antitrust laws, and with statutes regulating relationships with dealers and distributors.

Successfully represented leading North American energy producer in defense of state criminal antitrust claims that were resolved without a criminal conviction

Participated in representing a corporation in recovering $500 million against a competitor for antitrust and unfair trade practices

Represented an international auto supplier in a federal criminal antitrust case

Represented an international auto supplier in multi-district class actions alleging price-fixing and market allocation

Served as trial counsel for a national direct-mail advertising company in its legal battle with News America, Inc., a part of Rupert Murdoch’s News Corporation. Obtained a $300 million jury verdict after an eight-week trial, the eighth-largest jury verdict in the United States in 2009, leading to a $500 million settlement including related California litigation

Represented hospital system challenging the enforceability of an exclusive contract between a cancer center and an academic hospital

Prosecuted an antitrust counterclaim against a competitor that asserted our client, an engineering software company, had misappropriated the competitor’s trade secrets 

Defended a furniture manufacturer against price discrimination lawsuit by a terminated retailer in the District of Oklahoma

Served as co-counsel for major computer and software vendor defending antitrust and intellectual property claims by a competitor seeking damages in excess of $1 billion

Defended a national grocery retailer against claims of attempt to monopolize and tortious interference brought by a local retailer.  The district court granted summary judgment dismissing all claims

Represented a national road construction company in connection with a federal criminal antitrust investigation, successfully convincing the Department of Justice not to seek an indictment
