FTC Resolves Privacy Charges Against Online Shopping Cart Service

CartManager International (CartManager) is a company that provides online shopping cart software and related services to e-merchants. The Federal Trade Commission leveled charges against CartManager for 'renting' personal information about the e-merchants' customers when CartManager knew that such activity was prohibited by the e-merchants' respective privacy policies. The terms of the agreement include: (a) barring CartManager from disclosing previously collected personal information; (b) mandating that CartManager's future information sharing practices are consistent with those of the e-merchants the company is servicing, unless otherwise clearly and conspicuously disclosed and (c) requiring CartManager to forfeit its profit from the sale of the personal information.
