Kelly M. Martorano is experienced in managing and negotiating environmental issues in many national and international corporate and real property transactions, including liability and compliance assessments and permit transfers. She advises corporate and municipal clients regarding environmental assessments, due care and remediation as they relate to the Comprehensive Environmental Response Compensation and Liability Act (CERCLA), Resource Conservation and Recovery Act (RCRA) and the Emergency Planning and Community Right to Know Act (EPCRA). She has worked with and advised corporate and municipal clients with permitting and compliance matters under the Clean Air Act, Clean Water Act, Toxic Substance Control Act, Department of Transportation regulations and RCRA, and all of their various state counterparts.

Experience

Kelly assisted clients who were members of a professional condominium complex in negotiations with the Michigan Department of Environmental Quality (MDEQ) regarding state and local river and stream management requirements and floodplain regulations.

My work assisting one of the firm's partners with this matter helped the client interact more effectively with the MDEQ and achieve compliance with the law. We also helped the clients save their parking lot from further damage due to erosion into the adjacent river and complete the project cost effectively. Overall, we achieved a positive outcome for the client and the environment.”
