Eric C. Bartley represents financial institutions and special servicers in all stages of commercial real estate workouts and foreclosures for both securitized and portfolio loans primarily in Michigan, Illinois, Indiana, and Ohio and in connection with the interpretation, negotiation, and drafting of commercial loan documents.  Eric handles a portfolio of loans with principal balances totaling in excess of $300 million and secured by a variety of property types including, multifamily, office, retail, industrial, manufactured housing communities, and hospitality.

Every case is different and each client has different goals and objectives in mind.  Knowing that, I go to great lengths to listen and fully understand the ultimate business objective my client is seeking to achieve in any given situation.  Starting with that objective, I work with my clients to plan the most efficient legal strategy to achieve their desired result.

  • Non-judicial and judicial foreclosures in state and federal courts in Michigan
  • Judicial foreclosures in Indiana, Illinois, and Ohio

Eric has obtained numerous receiverships, and successfully pursued borrowers and guarantors in deficiency actions in both recourse loan documents and through carve-out violations in non-recourse loan documents.  In addition, Eric has been intimately involved in successfully representing lenders in defending against lender liability claims.
