Eric Bartley represents financial institutions in all aspects of commercial real estate finance. Specifically, he has served as counsel for national lenders in commercial mortgage originations across the country on portfolio loans as well as conduit loans intended for securitization in the capital markets. Eric brings to his origination practice an extensive background and companion practice in representing financial institutions and special servicers in all stages of commercial real estate workouts and foreclosures for both securitized and portfolio loans. He has handled matters for nearly $1 billion of distressed assets secured by a wide range of property types including multifamily, office, retail, industrial, manufactured housing, and hospitality.
The true sign of great legal counsel is the ability to listen to your client's business objectives and to isolate from those discussions the key legal, business, and practical issues that must be addressed in order to successfully achieve those objectives. Drawing from this ability, as well as my extensive background in representing lenders in both transactions and litigation related to distressed commercial loans, I work collaboratively with my clients on their origination matters to ensure their rights are adequately protected and the deal closes.

Experience
Eric has represented national lenders on commercial mortgage loan originations secured by retail, office, multifamily, industrial, and manufactured housing properties across the country.
Eric has represented national lenders and special servicers with deeds-in-lieu of foreclosure, deeds-in-escrow, forbearance agreements, loan modification agreements, receiverships and receivership sales, non-judicial foreclosures, and judicial foreclosures in both state and federal courts in Michigan, Illinois, Ohio and Indiana.
Eric has represented national lenders in succesful pursuit of borrower and guarantors in deficiency litigation under recourse loan documents as well as through carve-out violations under non-recourse loan documents.
Eric has represented national lenders in the successful defense against lender liability claims.
