David R. Mitchell represents financial institutions in deals of varying size and complexity in Michigan, California and throughout the United States. His experience includes negotiating intercreditor agreements, secured and unsecured transactions, and letters of credit in support of tax-exempt financing. He is able to focus the client on the issues that are important, allowing the client to negotiate deals that satisfy the customer while ensuring the client is protected. Because he sees a variety of types of deals, David can judge the type of negotiation and documentation that is appropriate for each deal.

Experience

A bank was financing the redevelopment of an historic residential property in which the land was governed by a development agreement with the city. The city's form of development agreement would have put the bank in an unfavorable position, but the city was unwilling to agree to the bank's terms. David was able to negotiate an agreement with the city that protected the bank and enabled the development to move forward.

When financing for this important project was in jeopardy, I created a solution that obtained what was most important to the client while working within a limited framework due to the political realities of the transaction.”
